1. Introduction

Octovate ("Octovate," "we," "us," or "our") operates the website octovate.io and the Octovate platform, an AI-driven software solution, together with related products, services, and applications (collectively, the "Services"). This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit our website or use our Services.

We are committed to protecting your privacy in accordance with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian federal and provincial privacy legislation. By accessing or using the Services, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy.

2.1 Information You Provide to Us

  • Account information: name, email address, phone number, company name, job title, and password when you register for an account.
  • Billing information: payment card details, billing address, and transaction history (payment card data is processed by our third-party payment processors and is not stored on our servers).
  • Content and data you submit: information, files, records, and other content you upload, input, or otherwise provide through the Services ("Customer Data").
  • Communications: information you provide when you contact support, request a demo, subscribe to communications, or otherwise correspond with us.

2.2 Information Collected Automatically

  • Usage data: pages viewed, features used, actions taken, dates and times of access, and referring URLs.
  • Device and technical data: IP address, browser type and version, operating system, device identifiers, and language preferences.
  • Cookies and similar technologies: we use cookies, pixels, and similar technologies to operate the Services, remember preferences, analyze usage, and support marketing. You can manage cookies through your browser settings; disabling certain cookies may affect functionality.

2.3 Information from Third Parties

  • We may receive information about you from third-party services you connect to the Services (for example, CRM, email, calendar, or authentication providers), from business partners, and from publicly available sources, in each case in accordance with the permissions you grant and applicable law.

3. How We Use Your Information

  • To provide, operate, maintain, and improve the Services;
  • To create and manage your account and authenticate users;
  • To process transactions and send related information, including confirmations and invoices;
  • To power AI-driven features of the platform, including generating outputs, insights, and automations based on data you provide;
  • To respond to inquiries, provide customer support, and send administrative messages;
  • To send marketing communications where permitted by law and consistent with Canada's Anti-Spam Legislation (CASL), with the ability to opt out at any time;
  • To monitor and analyze usage and trends to improve functionality and user experience;
  • To detect, prevent, and address technical issues, fraud, security incidents, and misuse; and
  • To comply with legal obligations and enforce our agreements.

4. AI Processing of Data

The Services include artificial intelligence and machine learning capabilities. Customer Data you submit may be processed by our AI systems, including through third-party AI service providers, in order to deliver the features you request. We do not use your Customer Data to train generalized AI models for other customers without your consent. AI-generated outputs may contain inaccuracies, and you are responsible for reviewing outputs before relying on them.

5. How We Share Your Information

We do not sell your personal information. We may share information in the following circumstances:

  • Service providers: with vendors who perform services on our behalf, such as cloud hosting, payment processing, analytics, AI infrastructure, and customer support, under contractual obligations to protect your information;
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case personal information may be transferred as part of the transaction;
  • Legal requirements: where required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Octovate, our users, or others; and
  • With your consent: for any other purpose disclosed to you at the time of collection or otherwise with your consent.

6. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including to provide the Services, comply with legal, accounting, or reporting obligations, resolve disputes, and enforce agreements. When personal information is no longer required, we securely delete or anonymize it.

7. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction, including encryption in transit, access controls, and monitoring. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. International Data Transfers

Your information may be stored and processed in Canada, the United States, or other jurisdictions where we or our service providers operate. Where information is transferred outside your province or country, it may be subject to the laws of those jurisdictions, including lawful access by courts, law enforcement, and national security authorities. We take steps to ensure that transferred information receives a comparable level of protection.

  • Request correction of inaccurate or incomplete personal information;

  • Request deletion of your personal information, subject to legal retention requirements;
  • Opt out of marketing communications by using the unsubscribe link in our emails or contacting us directly; and
  • Challenge our compliance with this Privacy Policy by contacting our Privacy Officer.

10. Children's Privacy

The Services are intended for business use and are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.

11. Third-Party Links and Services

The Services may contain links to third-party websites or integrate with third-party services. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies before providing them with personal information.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and, where the changes are material, provide additional notice such as an email or in-app notification. Your continued use of the Services after changes take effect constitutes acceptance of the revised policy.
